Rule of law guarantees civil order, prevents chaos

 The law is important for a society and it serves as a norm of conduct for citizens. It was also made to provide for proper guidelines and order upon the behavior for all citizens and to sustain the equity on the three branches of the government. It keeps the society running. Without law there would be chaos and it would be survival of the fittest and everyman for himself. Not an ideal lifestyle for most part.

Recently a finding by the Lawyers Association and the Pajhwok Afghan News on the 14th anniversary of the constitution’s adoption reveals the constitutional violations over the past 14 years.

The two organizations conducted a survey on public awareness regarding the law and its implementation, the level of people’s access to justice, effectiveness of the law and the best right and freedoms provided by the law. The report says that ninety-four article of the constitution has been violated, with four of 10 people having little information about the basic law and more than half complaining they have no access to justice.

People say of every 10 individuals three enjoy their legal rights, and that the law has brought positive changes to the lives of six out of every 10 Afghans. Many call the freedom of expression the best right they have been granted by the constitution.

The report also says that the government was not that much able to implement the law, as the parliament has also failed to discharge its responsibilities. The absence of judicial institutions in half of the districts has also restricted law enforcement in some areas.

Both historically and culturally, Afghanistan has encountered problem in the field of rule of law. Social, economic and cultural backwardness, mainly tribal structures, the emergence of fundamental and ideologue groups and bloody battles for power and interference of foreign governments are considered as major factors in this regard.

Now the country’s most of the new generations have realized that it is more dangerous to tolerate worsening conditions of lawlessness, discrimination, misery, violence, hatred and incompetency anymore. 

The National Unity Government since its inauguration has determined to fight corruption and improve rule of law as well as local governance.  A strong, clean, stable and accountable government will serve best the interests of the people of Afghanistan and will deliver the required services to the nation.

Meanwhile to strengthen Afghanistan’s ability to maintain law and order, the Afghan government and the allies should work closely to build and maintain a professional police force and implement the necessary reformation.

Despite government’s eye-catching achievements in rule of law and anti-corruption efforts, the government also needs to take concrete steps to assure that the laws are enforced by not only the public but also the state bodies and the political elites.

The people are required to obey the law and the government also needs to take specific actions to deal with the current cases of violations of the law by the powerful individuals.
